Some gaps about usufruct rights under Vietnamese law

Abstract

In today’s society, assets in the form of usufruct rights are increasingly diversified and tend to increase over time and this is a new right stipulated in the Civil Code 2015 (Quốc hội, 2015). Therefore, the law governing usufruct rights has some shortcomings such as the duration of usufruct, the return of property is the right to enjoy when contributing capital to the company, property registration is usufruct right, who must compensate for damage caused by the usufruct property. These inadequacies will be explained by the article, pointed out through the methods of searching, analyzing, deducting, and inducting, in order to predict consequences and reduce risks for entities when participating in transactions with this type of financial asset. This property and make suggestions to improve the law on usufruct rights on the inadequate issue.
