Abstract

At present, strengthening the litigants’ right to litigate in the trial is an important idea of the judicial reform strategy promulgated by the Politburo. This idea has been institutionalized into the principle of “confident litigation is guaranteed” in Clause 5, Article 103 of the 2013 Constitution. In this article, the author will specifically refer to the litigants’ right to litigate in court during trial preparation. In addition to the legal provisions, the article analyzes many objective and subjective factors to ensure the litigants’ right to litigate in civil proceedings in Vietnam.
