Abstract

Abstract: The dispute settlement system of the World Trade Organization (WTO) is
facing its grave crisis, leading to no appeals to be heard by the Appellate Body since
2019. In response, WTO members have proposed interim alternative measures; One of
which is the arbitration mechanism under Multi-party Interim Appeal Arbitration
Arrangement (MPIA) pursuant to Article 25 of the DSU. This article aims to clarify
legal issues of this appellate arbitration under the MPIA, thereby proposing
recommendations for Viet Nam.
