Abstract
Abstract: In addressing the issue of the criminal responsibility of legal entities, two
primary scientific viewpoints currently exist. The first holds that a legal entity is merely
the subject of criminal responsibility but not the subject of a crime. The second, more
traditional viewpoint, asserts that a legal entity, like an individual, is both the subject of
a crime and the subject of criminal responsibility. Depending on the viewpoint and
approach adopted, the issue of complicity in cases where a legal entity commits a crime
may lead to varying legal consequences. Within the scope of this article, the author does
not seek to evaluate the correctness of these scientific viewpoints but instead highlights
the legal issues that arise from each perspective.
