Abstract

Abstract: The age of criminal responsibility occupies an important place in every
national legal system; all member states of the United Nations, in one form or another,
prescribe the minimum age of criminal responsibility. The law of the People's Republic
of China (China) has long prescribed a minimum age of criminal responsibility. Based
on an examination of the provisions on the age of criminal responsibility in Chinese
criminal law, and through a comparative analysis that clarifies their advantages and
limitations in relation to the corresponding provisions of Vietnamese criminal law, the
author proposes recommendations to improve Vietnam’s provisions on the age of
criminal responsibility in the future.
Keywords: Age of criminal responsibility; Chinese criminal law; Vietnamese
criminal law.
