Abstract
Global economic integration and the expansion of trade liberalization have significantly promoted the signing of Free Trade Agreements (FTAs) worldwide, including in Vietnam. This development presents numerous opportunities and challenges for Vietnamese businesses in manufacturing products and competing in both domestic and foreign markets. Consequently, there is an increased likelihood of defective and potentially harmful products entering the market. Therefore, it is crucial to investigate which entities are responsible for compensating consumers for damages caused by defective products. This article analyzes the provisions of current Vietnamese law and the 2023 Law on Consumer Protection concerning the liability for such damages. Additionally, it explores foreign laws to facilitate a comparative analysis and draw insights that could enhance Vietnamese legislation.
