Abstract

Applying the principle of reciprocity in recognition and enforcement civil judgments and decisions of foreign courts is one of the principles and grounds for courts to resolve civil matters involving foreign elements. However, the concept, method of application, burden of proof in the law are not clear and complete. Therefore, the article will focus on analyzing: (1) Legal regulations and practice of applying the principle of reciprocity in recognition and enforcement of civil judgments and decisions of foreign courts in China national; (2) Compare the similarities and differences between Vietnam and China to propose improving the law and consistently applying this principle in practice in Vietnam
