Abstract

The transfer of the right to claim for reimbursement is an integral feature of property insurance contract relationships. The insurer may invoke this stipulation to seek indemnity on behalf of the insured for the losses suffered if caused by the wrongful actions of a third party. Currently, the provisions regarding the transfer of this right in property insurance contracts are specifically prescribed in Article 54 of the Law on Insurance Business 2022. However, these regulations exhibit inconsistencies and undermine the efficiency of legal processes.
