Abstract

Along with the petitioner, the respondent is one of the two entities present in every administrative case. Unlike the petitioner, the respondent appears passively in the administrative case. However, the presence of the respondent plays a key role in resolving the administrative case. Because, this is the subject whose state management object is sued.Therefore, at each stage in administrative proceedings, the Law on Administrative Procedure 2015 will have different provisions on the presence of the respondent. This article focuses on analyzing the provisions of the law; assess the limitations and inadequacies of the law regarding the presence of the respondent in administrative proceedings. From there, the article will make some recommendations to improve the law on the presence of the respondent in administrative proceedings.
