Abstract

The 2015 Penal Code, as amended and supplemented in 2017 (BLHS), has established a solid legal foundation for combating crime and addressing criminalrelated matters, including the determination of an individual’s criminal history. Although the Penal Code contains provisions on the “automatic expungement of criminal records” for individuals, inconsistencies remain in its practical application. These include differing interpretations and guidelines among legal practitioners, judicial bodies, and legal experts regarding the conditions under which criminal records are deemed automatically expunged. This article aims to analyze and evaluate the current legal framework and its implementation in Vietnam, while also examining relevant legal provisions from selected countries around the world. On this basis, the author proposes recommendations to enhance legal clarity and ensure consistency in the application of the law.
