Abstract

The Civil Code of 2015 stipulates that natural and legal persons have the right to use adjacent real estate belonging to others to serve their own real estate exploitation, under the conditions provided by law. Among these easements, the right of passage is an important right, widely applied to meet the needs of travel, production, or business of the owner of a landlocked property. Within the framework of this article, the authors analyze and explain the key legal terms related to the right of passage, and the application of law by the courts to resolve disputes in this area, thus highlighting the inadequacies and proposing solutions to improve the relevant regulations.
