Abstract
Resolution 98/2023/QH15 of the National Assembly stipulates 44 special mechanisms, including allowing Ho Chi Minh City to pilot the Transit-Oriented Development (TOD) urban development model. The city has approved a list of seven TOD development locations along Metro Line 1, Metro Line 2, and Ring Road 3. Accordingly, land areas around metro stations will have increased floor area ratios and population densities to attract and accommodate residents. However, after one year, Ho Chi Minh City has yet to establish a TOD for urban rail or Ring Road 3. While Resolution 98/2023/QH15 allows for piloting, a more specific legal framework is needed as a legal basis for implementation. This article analyzes the special mechanisms granted to Ho Chi Minh City under Resolution 98/2023/QH and proposes several recommendations to improve the legal framework in order to enhance the effectiveness of these special mechanisms in piloting Transit-Oriented Development (TOD) in Ho Chi Minh City.
