Abstract

A three-dimensional trademark is a sign represented in a three-dimensional spatial form comprising length, width, and height with the function of distinguishing the goods or services of different entities. Currently, many legal systems around the world recognize the protectability of threedimensional trademarks; however, there remain significant differences across jurisdictions. This article analyzes the concept and conditions for protecting three-dimensional trademarks under Chinese law, identifies similarities and shortcomings, and offers insights and lessons to help improve the legal framework on the concept and protection requirements of three-dimensional trademarks in Vietnam, in line with international practices and commitments.
