Abstract

This article analyzes the provisions of Vietnamese criminal law, combined with a comparison to international instruments such as the United Nations Convention on the Rights of the Child, the Beijing Rules, and the Joint Commentary No. 24 of the Commission on the Rights of the Child. It clarifies the significant shifts in legislative thinking towards promoting restorative justice, diversionary measures, and child-friendly proceedings. The article assesses the compatibility of the principles for handling juvenile offenders in Vietnamese law with international standards, while also pointing out the limitations and challenges in its implementation in the future.
