ABOLITION OF FORCED LABOR ACCORDING TO VIETNAMESE LAW

Abstract

Forced labor is one of the labor relations’ downsides, infringing upon the labors' right to freely choose jobs, in many cases directly violating human dignity and physical freedoms of labors. Under the forced labor, labors are not respected and not guaranteed legitimate rights. Forced labor is an expression of injustice and obviously it does not encourage the positivity and creativeness of labors. Therefore, maintaining forced labor status reduces labor productivity without benefits for the general development of society. The prevention and timely detection of forced labor bring many important benefits, namely, ensuring fairness for labors or adequate compensation for the effort that labors spent in the process of working; preventing exploitation of people in social relations in general and in labor relations in particular.

This scientific paper focuses on the following contents: generalizing Vietnamese law on forced labor and abolition of forced labor through analyzing the legal basis from the Labor Code 2012, the Criminal Code 2015, The Law on Vietnamese workers working overseas under contract 2006..; analyzing the current situation of forced labor in Vietnam today and then indicating limitations and some solutions to improve the laws.
