RIGHTS AND OBIGATIONS OF INVESTORS IN BUILD – OPERATE – TRANSFER CONTRACTS UNDER VIETNAMESE LAW

Abstract

Investing under BOT contract has been attracting the attention of investors (Investors) and the whole society. This is even more special when the National Assembly has just passed the Law on Investment in the form of Public Private Partnership in 2020 (Law on Public Private Partnerships). In which, the issue that investors are very concerned about is how their legal rights and benefit are guaranteed by law when investing capital in BOT contracts. However, through studying the regulations, especially the Law on Public-Private Partnership, it is found that some regulations on the rights and obligation of investors still have shortcomings. Therefore, the article aims to analyze in order to specify the inadequacies from which to propose a solution to complete the provisions of the rights and obligations in BOT contracts.
