E-COMERCE DISPUTE SETTLEMENT BY ONLINE METHODS IN THE ERA OF 4.0 TECHNOLOGY REVOLUTION

Abstract

In recent years, e-commerce activities in Vietnam have developed strongly and dramatically. Sales activities not only take place on domestic applications such as Lazada, Tiki, Fabook... but also on international trading applications  as Teesrping, Teechip, sunfog, Ebay, Amazon FBA, Dropshipping, Alibaba .... In e-commerce trade, like traditional commercial activities, disputes also arise between the subjects participating in the transactions. Therefore, it is necessary to have dispute settlement methods suitable to the nature of e-commerce transactions.

Online dispute resolution is considered to be the most appropriate method to settle disputes arising from e-commerce. However, so far in Vietnam, there is no synchronous mechanism to resolve disputes online. This article focuses on analyzing and clarifying the concept and characteristics as well as analyzing and assessing the current status of the e-commerce dispute settlement mechanism in Vietnam, thereby proposing some recommendations to develop and improve the efficience of the online commercial dispute settlement meeting the demand of the industrial revolution 4.0.
