ASSESSMENT OF FEASIBILITY AND COMPATIBILITY TO FAMOUS TRADEMARK IN DRAFT LAW ON AMENDING SOME ARTICLES OF INTERNATIONAL INTELLECTUAL PROPERTY LAW AND GIVING PROPOSITIONS

Abstract

The Law on Intellectual Property in 2005, amended and supplemented in 2009, 2019 mentioned well-known trademarks. However, in the application process, there are still many shortcomings, not feasible and compatible with international treaties on intellectual property, and well-known trademark protection practices in Vietnam. The purpose of the article is to evaluate the compatibility, suitability and incompatibility in the provisions of the draft Law amending and supplementing a number of articles of the current Intellectual Property Law with international treaties and practice and protecting well-known trademarks in Vietnam, and propose specific adjustment plans for famous trademarks.
