Covid-19 is a force majeure event or a hardship – from legal perspective

Abstract

Covid-19 has been affecting the socio-economic situation of Vietnam in general and commercial contractual relations in particular. In disputes over commercial contracts due to the effects of Covid-19, notably, disputes related to the determination of Covid-19 as a force majeure event or a hardship. The article analyzes the legal provisions on force majeure events as well as the hardship, the causes of legal disputes over commercial contracts related to the determination of Covid-19 as a force majeure or a hardship; from there, give some notes to businesses when agreeing to establish commercial contracts in the current situation of the Covid-19 epidemic.
