Commentary on Chapter 1 of the Draft Law on Extradition

Abstract

This article analyzes and comments on the core contents of Chapter I of the Draft Law on Extradition, including its scope of regulation, subjects of application, interpretation of terms, principles of extradition, extraditable offenses, and the death penalty. Through a comparison of the draft’s provisions with current Vietnamese law, relevant international treaties, and legislative practices of selected countries, the article highlights progressive aspects, identifies existing gaps and inconsistencies, and proposes recommendations for improving Chapter I of the Draft Law. The research findings contribute to the development of a modern, coherent, and internationally harmonized extradition law that aligns with both international standards and Vietnam’s legal practice.
