Conditions for the application of provisional emergency measures prohibit the transfer of property rights for disputed property

Abstract

Among the provisional emergency measures prescribed by Vietnamese law, one of the most proposed measures by many concerned parties is the Prohibition on the transfer of property rights in the cases of disputed property. To effectively and accurately apply the measure of Prohibition on the transfer of property rights in the cases of disputed property, when considering whether or not to apply the Law on the Prohibition of transferring property rights to the disputed property, the court needs to consider both subjective and objective factors. In this article, the author presents the basic legal issues related to the application of provisional emergency measures prohibiting the transfer of property rights in the cases of disputed property, including some inadequacies and recommendations to improve legal regulations.
