Regulations on solicitation of assessment in criminal proceedings

Abstract

Judicial assessment is one of the important judicial auxiliary tasks to serve as a basis for settling cases. Solicitation of assessment in criminal proceedings means an investigative activity of a competent authority, conducted in order, procedures being prescribed by the criminal procedure law for the purpose of collecting, consolidating, examining, evaluating, establishing evidence, serving the investigation and handling criminal cases. Although the Criminal Procedure Code has specified the circumstances in which it is compulsory to solicit an assessment, there are still problems in some cases such as wood assessment, animal species assessment,… The study of limitations and problems of legal regulations, practice and solutions, will contribute to overcoming the limitations, including the omission of grounds for referral of assessment in criminal proceedings. The research objective will contribute to solving difficulties and problems in the examination referendum. Research methods that analyze written law will be summarized and compared. The work has scientific significance in terms of law, contributing to improving the efficiency of the judicial review referendum in criminal proceedings, and creating a solid legal basis when settling criminal cases.
