Compensation for damage caused by environmental pollution by commercial legal entities – current situation and solutions

Abstract
The Law on Environmental Protection 2020, which took effect from January 1, 2022, had made strong developments and new points in environmental protection against harmful agents, including the provision of liability for compensation due to environmental pollution and degradation by organizations, individual cause. However, after two years of implementing the law, there were still some shortcomings and difficulties in the implementation process. This study focused on analyzing the legal provisions on compensation for damage caused by environmental pollution by commercial legal entities and its difficulties in the implementation process such as the right to sue the infringed entities, the issue of responsibility to assist people in collecting evidence as well as determining damages made grounds for determination of compensation fees. From there, the study proposed solutions to contribute to the complete law.
