Abstract

Sexual harassment in the workplace is a serious problem, affecting not only the personal rights of employees but also negatively affecting the working environment and work efficiency. Although Vietnamese law has initial regulations on preventing and combating sexual harassment in the workplace, current regulations are still lacking in detail and not strong enough to protect employees and effectively handle violations. The main problems include identifying sexual harassment, lack of strong sanctions, unclear complaint handling procedures, and limited protection of victims. From the above issues, the  authors focused on pointing out the legal shortcomings of sexual harassment in the workplace as stipulated in the 2019 Labor Code and some experiences in protecting employees in the workplace in some countries, to make some recommendations to improve the mechanism to protect employees against harassment in Vietnam.
