Improving the legal framework for the resolution of individual labor disputes by labor mediators

Abstract
Amidst the current trend of globalization, labor disputes arising from conflicts of interest between employees and employers are becoming increasingly prevalent. In order to settle these disputes, Vietnamese law has stipulated the competent authorities for resolving labor disputes. Mediation, conducted by labor mediators, serves as the initial phase of dispute resolution, facilitating dialogue and agreement between the parties involved. This study examines the shortcomings and inconsistencies in the existing legal framework governing labor mediation, and proposes recommendations to enhance the legal basis for the resolution of individual labor disputes by labor mediators, thereby safeguarding the legitimate rights of both parties and promoting labor relations stability.
