Regulations on issuing work permits for foreign workers in Vietnam- shortcoming and some recommendations

Abstract

In the context of international economic integration, labor movement between countries is an inevitable trend. Therefore, each country has issued policies and legal regulations to manage foreign workers. A work permit is one of the conditions for foreign workers to be allowed to work in Vietnam. Rules on work permits have improved management efficiency and employment of foreign workers in Vietnam. Especially since Decree No. 70/2023/ND-CP dated September 18, 2023, was issued, many obstacles to granting work permits to foreign workers working in Vietnam have been removed. However, during the implementation process, these regulations still reveal certain limitations. This study summarized the provision of the 2019 Labor Code and some related documents on granting work permits to foreign workers in Vietnam. Thereby, the authors point out some inadequacies and limitations and make recommendations to improve Vietnam’s legal regulations on granting work permits to foreign workers working in Vietnam in particular and the management and employment of foreign workers in general.
