Business names in Vietnamese law on enterprise from a comparative law perspective

Abstract
In Vietnamese law, the name of a business plays an important role as it is one of the four conditions for the state to consider granting business registration to investors. This is an issue that has been studied by scholars from different perspectives. This article aims to analyse the current state of Vietnamese enterprise law relating to business names in comparison with the business laws of some countries in the world in terms of provisions on business name structure, prohibitions in naming businesses, and registration to reserve business names. The results show that Vietnamese business law does not have provisions on reserving business names like the laws of countries such as the United States, Australia, and Singapore; and the provisions on prohibitions on naming businesses in Vietnam have certain differences compared to other countries in the world. Thereby, the article makes some recommendations for Vietnam in learning from the legislative experience of other countries in the world to improve enterprise law on business names in the coming time.
