Abstract
The paper analyses and assesses the relationship between the civil procedure law and the civil law. It points out inconsistencies between the civil procedure law and the civil law in regard to the scope of resolving civil law matters by the court, the judicial jurisdiction to settle civil law matters, the representative of parties in civil proceeding, the right to initiate civil law cases, grounds for rejecting initial petitions of civil law cases and some grounds for suspending the resolution of civil law cases. It also suggests directions for overcoming the above-mentioned inconsistencies and imporving the civil procedure law in relation to the civil law in order to ensure the consistence between the civil procedure law and the civil law.
