A posteriori control of constitutionality under the French law and lessons learnt for Vietnam

Abstract

The paper briefly presents the history of a posteriori control of constitutionality under the French law. It introduces legal provisions and some precedents of courts and the Constitutional Council of France on a posteriori control of constitutionality. The paper also compares the law on a posteriori control of constitutionality of Vietnam with that of France. It then offers proposals for improving the law on a posteriori control of constitutionality of Vietnam based on the French experience.
