Settle the relation between area-based management tools and rights of coastal states

Abstract

There has been a state level process in negotiating a new international legal binding instrument on Marine biodiversity beyond areas national jurisdiction (BBNJ). Such instrument will show a great effect on the rights of coastal states, including Vietnam. This paper analyzes the debates in the negotiations to support the notion that: the establishment of Area- based management tools (ABMTs), including marine protected areas (MPAs), should take into account the rights of coastal states to all areas under their jurisdiction.
