The protection of IP rights according to the new generation of free trade agreements: CPTPP & EVFTA

Abstract

Recently, Vietnam has signed some trade agreements with other countries, among which the Comprehensive Progressive Trans-Pacific Partnership (CPTPP) and Vietnam Free Trade Agreement - The EU (EVFTA) are considered to be the new generation of free trade agreements because of its broader scope of adjustment than the traditional ones. Both CPTPP and EVFTA offer provisions on the protection of IP rights. Although these provisions basically are based on the IP regulations of WIPO and WTO, many new legal contents have also been added (such as the objects of protection, the standards of protection, ways of enforcement...). For all of the above reasons, this article focuses on analyzing and giving comments on provisions of IP rights protection in accordance with CPTPP and EVFTA's regulations and suggests recommendations to further improve Vietnam's IP law.
