Abstract

Recognition of land use rights is a method of establishing land use rights. This method directly affects the interests of many people, especially households and individuals who have established land ownership before the time when the land is declared to be owned to the entire people (bona fide possessor). However, some provisions of the Land Law on the recognition of land use rights are ambiguous, causing difficulties in understanding and applicating, affecting the legitimate interests of land-using households and individuals, and social stability. In order to overcome this situation, the article addresses the following issues: The definitions of foundation for recognizing land use rights. Based on this foundation, how should the provisions of the Land Law 2013 be amended and supplemented to protect the rights and interests of the involved parties?
