Legal provisions on cancellation of asset auction results for enforcement of civil judgment and some recommendations

Abstract

The cancellation of asset auction results for enforcement of civil judgment has an impact on the subjects' legal rights and interests, such as judgement’s debtors, creditor, auction winners... This article studies a number of drawbacks and obstacles faced by subjects who are entitled to file a lawsuit to cancel the auction result, the statute of limitations for such actions, and the court's jurisdiction over the cancellation of auction results. From this ground, it provides some recommendations to improve the legal provisions regarding these issues.
