Management rights of general partners in an auction partnership – A comparison of Vietnamese, French and Japanese laws

Abstract

The article studies and analyses the provisions of Vietnamese law on the management rights of general partners in an auction partnership in comparison with French and Japanese laws. On that basis, the article highlights existing limitations and inadequacies in the provisions of Vietnamese law, draws lessons from the legal experience of France and Japan, and, based on Vietnam’s foundational economic, political, and social institutions, makes recommendations for amending and supplementing Vietnam’s legal provisions on the business management rights of general partners in auction partnerships.
