The notarization of documents related to marital property

Abstract

According to the Law on Marriage and Family and the Law on Notarization, a number of documents related to marital property can be certified at a notary at the request of either spouse or as prescribed by law, such as: written agreements on the division of marital property acquired during marriage; written agreements on the division of marital property upon divorce; contracts on giving marital or separate property; documents certifying the separate property of the husband or wife, etc. In practice, many problems and inadequacies arise due to different understandings of problems such as determining marital property, separate property, the willingness of the husband and the wife, etc. The article focuses on analysing the issues that arise in the notarization of the abovementioned documents from a legal and practical perspective. At the same time, the author provides arguments to express personal viewpoint on issues where there are many different opinions.
