Legal representative of credit institutions: practice and some suggestions for implementation

Abstract

This paper identifies and clarifies several deficiencies and limitations in the regulatory framework on the legal representative of credit institutions under the current Law on Credit Institutions by analysing and comparing the provisions for representatives of juridical persons in the Civil Code and the provisions on legal representatives of enterprises in the Enterprise Law, as well as the practical implementation of these provisions. Based on the research findings, this article proposes several recommendations for improving the effectiveness of law implementation, and for addressing the inadequacies and limitations arising from the application of the provisions on legal representatives of credit institutions, which contribute to guaranteeing consumers' interests and the credibility of credit institutions.
