Cases where prescriptive periods are not applicable under the provisions of Vietnam’s civil law

Abstract
Article 155 of the 2015 Civil Code was promulgated to regulate the non-applicability of prescriptive periods. This provision, when applied in practice, has led to many different interpretations and applications. This article analyses current legal provisions, evaluates practical application and makes suggestions to improve the law and its application on not applying prescriptive periods to civil actions in the following cases: 1) Request for the protection of personal rights not associated with any property; 2) Request for the protection of ownership rights, unless otherwise provided by the Civil Code or relevant laws; 3) Dispute over land use rights as prescribed in the Law on Land; 4) Other cases as provided for by law.
