The laws in Germany and Switzerland regarding the adoption of children by same-sex couples and some recommendations for Vietnamese legislation

Abstract

Same-sex couples (including registered partnerships and same-sex marriages) are legally recognised in Germany and Switzerland, giving them the right to adopt children. Depending on the circumstances, they can adopt jointly or separately, ensuring the rights of same-sex parents and providing a stable family environment for children in need, reducing the social burden. This article studies the adoption rights of same-sex couples as stipulated by German and Swiss laws and proposes that Vietnamese law recognises registered partnerships for same-sex couples as a precursor to legalising same-sex marriage, allowing them to adopt jointly or separately in order to ensure the legitimate rights and interests of adopters and adoptees.
