IMPROVING THE CONCEPT OF CRIME UNDER THE VIETNAMESE CRIMINAL LAW

Abstract

In accordance with the concept of crime prescribed in Section 1, Article 8 of the 2015 Criminal Code and with reference to the concepts of crime under the Criminal Codes of some other countries and the viewpoints of scholars, the paper proposes the exclusion of the provisions enumerating social relations as the crime’s object and prescribing charateristics of the crime’s subject from the concept of crime in order to make it  eitheir more brief, concise and general or comprehensively reflect the core features of the crime.
