IMPROVING THE LAW ON CAPITAL CONTRIBUTION AND SHARE PURCHASE OF COMMERCIAL BANKS

Abstract

The paper generally assesses the law on capital contribution and share purchase of Vietnam’s commercial banks at present, pointing out the limitations of the provisions on areas of performance,  requirements, limits and procedures for captical contribution and share purchase and based on that  offers some solutions for improving the law on this area. The solutions mainly focus on some following issues: clarification and unification of the provisions on forms and procedures  for capital contribution and share purchase, setting out  requirements that commercial banks need to meet for  permission of capital contribution and share purchase to enterprises which are non-credit institutions and supplementing the limits of share ownership and the right  of individuals to participate in leadership.
