Abstract

Focusing on personal and property relations between husband and wife once a spouse declared missing or dead, especially in the cases where the spouse declared dead comes back to life and restores the marriage relation, the paper analyses the current law and the practice of applying the law in this regard. It points out the inadequacies and shortcommings of the related law and offers recommendations for improving it in order to guarantee legitimate rights and interests of husband and wife, and other concerned parties.
