Legal mechanisms to ensure the enforcement of civil judgments and rulings having taken legal effect

Abstract

The paper analyses the shortcomings of the law which cause the risk of unenforceable implementation of civil judgments and rulings having taken legal effects such as: conflict; overlapping; lack of feasibility; and lack of strict rules to prevent judgment debtors from dispersing their assets or eluding their related obligations. By refering to some relevant examples and experiences of the Federal Republic of Germany, the paper offers some proposals to enhance the effectiveness and efficiencyof enforcing court judgments and rulings.
