Jurisdiction of commercial arbitration under Article 2 of the 2010 Law on commerical arbitration

Abstract

Article 2 of the 2010 Law on commercial arbitration prescribing jurisdiction of commercial arbitration serves as an important legal ground which significantly impacts on the scope of activities and thereby the role of commercial arbitration in settling business disputes in Vietnam. The paper offers comments on the issues relating to the contents and format of the Article including: the broadening of jurisdiction of commercial arbitration in comparision with the previous legal provisions and the remark on the way to prescribe jurisdiction of commercial arbitration in the correlation between Section 1 and Section 2 of Article 2 of the 2010 Law on commercial arbitration.
