Liability of intermediary service providers for copyright in fringements on the internet

Abstract

Technological developments, especially the Internet, have transformed the way copyrighted works are distributed to the public and raised the question about the role and liability of intermediary service providers for copyright infringements. This paper reviews the legal framework and relevant cases in the United States and European Union about copyright liability of online intermediaries and offers some recommendations for Vietnam. It is suggested that Vietnam could develop a regime of immunities for intermediary service providers as maintained in the United States and European Union.
