Functions to exercise the power to prosecute and supervise judicial activities in criminal procedure

Abstract

Under the current law of Vietnam, people’s procuracies have the two functions which are exercising the power to prosecute and supervising judicial activities. The paper analyses the differences in objectives, the scope and objects of exercising the power to prosecute and supervising judicial activities in criminal procedure and further explains the relationship between the two above-mentioned functions. On that basis, the paper offers some proposals to improve the provisions of the 2015 Criminal Procedure Code on duties and powers of people’s procuracies in exercising the power to prosecute and supervising judicial activities in criminal procedure.
