PRINCIPLES OF INTERNATIONAL ENVIRONMENTAL LAW AND THE ISSUE OF COMPENSATION FOR ENVIRONMENTAL HARMS

Abstract

The concern of each nation and the whole of humanity about environmental protection is growing. This is reflected not only in the emergence of more and more conventions, agreements on environmental protection with the integration of commitments relating to many aspects, including the application of economic instruments. In environmental protection, the liability to compensate for environmental harms is one of those effective instruments. The liability to compensate for environmental harms is governed by national law on basis of the polluters pay principle which is one of the fundamental principles of international environment law. In addition, other principles of international environmental law also greatly influence  the provisions of national law on the  liability to compensate for environmental harms. This article addresses the principles of international environmental law on  compensation for environmental harms which influence the contents and scope of the national law governing the liability to compensate for  environmental harms.
