Improving the law of Vietnam on government procurement covered by the CPTPP

Abstract

The Comprehensive and Progressive Agreement for Trans-Pacific Partnership (CPTPP) has come into force in Vietnam since January 14th,  2019, imposing urgent requirements  on Vietnam  to  implement  its commitments on government procurement by promulgating  a decree on specific guidelines for bidding packages covered by the CPTPP. The paper analyses the provisions of the CPTPP on government procurement. It examines the differences between these provisons and those under the current law on bidding of Vietnam. The paper then offers proposals to improve the draft Decree on specific guidelines for bidding packages covered by the CPTPP and that shall only be applicable to member states.
