Some legal aspects of title retention under the 2015 Civil Code

Abstract

On the basis of the requirements for improving the law on security for performance of obligations in general and title retention in particular and enhancing the regulatory efficency of the law on security for performance of obligations, the paper examines some legal aspects of title retention under the 2015 Civil Code: grounds for title retention; the security nature of title retention; rights and obligations of parties in title rentention; legal consequences in case where tile retention has an antagonistic effect against a third party; and the design of articles on title retention. The paper then concludes that regarding title retention the Civil Code still remains unclear, which does not show the security for performance of obligations and lacks the anticipation as well as the consistency between the tiles and the contents of the articles on title retention.
