The General part of the Penal code 2015 under the view of legislation technique

Abstract

Based on the two requirements of legal document’s technique – the logical composition and the scientific wording, this article analyzes the drawbacks of the “General Provisions” Part of the Penal Code 2015. These drawbacks concerns the composition of chapters, articles and clause, the connection and unification of the Code’s expression and wording. Together with the analyzation of these weaknesses, the article suggests recommendations in order to improve the legislation technique of the “General Provisions” Part of the Penal Code.
