Non – compete agreement in labour – Reality and legal aspects

Abstract

Non-compete agreement in labour has been acknowledged in the labour code of many countries to protect the employers’ trade secrets and prevent unfair competition. Due to the lack of regulations regarding ‘non-compete agreement’ in Vietnamese law, there has been confusion from authorities while resolving such disputes. This article will discuss the ‘non-compete agreement’ and its legal aspects from real-life cases and then, propose solutions to formulate a legal framework on non-compete agreement in the labour sector of Vietnam.
